Fitzella Terms of Service

These Terms of Service (“Terms”) govern your use of the Fitzella mobile application (“the App”), provided by Ahmad Yassine (“we,” “our,” “us”). By using the App, you agree to these Terms.

1. Eligibility

You must be at least 16 years old to use Fitzella. By using the App, you confirm that you meet this requirement.

2. Description of Service

Fitzella is a fitness tracking application. It includes a 14-day free trial with full access to all features. After the trial, the app continues on a free tier (limited to 4 lifetime workouts) unless you subscribe to Fitzella Pro.

3. Subscriptions and Payment

• Fitzella Pro is available as: Monthly ($9.99/month), Yearly ($59.99/year), or Lifetime ($149.99 one-time, iOS only)
• New subscribers receive a 14-day free trial with full access
• Subscriptions automatically renew at the end of each billing period unless cancelled before renewal
• Lifetime purchases are one-time and do not renew
• Subscriptions are billed and managed through the Apple App Store or Google Play Store, depending on your device
• Cancellations must be made through your Apple ID or Google Play account settings; we do not process cancellations directly
• Refunds are subject to the policies of Apple or Google, as applicable

4. Health and Fitness Disclaimer

Fitzella is a fitness tool, not a medical device, and does not offer medical advice. You should consult a physician or qualified healthcare provider before starting any new exercise program. You use the App at your own risk. We are not liable for any injury, health condition, or adverse outcome resulting from your use of the App.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, hack, or disrupt the App’s systems

6. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting us at support@fitzella.com.

7. Intellectual Property

All content, branding, and code within the App, excluding your personal logged data, are the property of Ahmad Yassine / Fitzella and may not be copied or redistributed without permission.

8. Limitation of Liability

To the fullest extent permitted by law, Fitzella and its creator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to injury, data loss, or subscription billing disputes handled by third-party platforms.

9. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of Sweden, without regard to its conflict of law principles.
